PLEASE READ THE FOLLOWING TERMS OF USE VERY CAREFULLY BEFORE USING FULGAZ CLUBS. THESE TERMS ARE IN ADDITION TO THE FULGAZ TERMS OF USE. BY APPLYING FOR ACCESS TO THE FULGAZ CLUBS FUNCTIONALITY, YOU ARE AGREEING TO ABIDE BY THESE TERMS OF USE. The FulGaz Clubs functionality (hereafter “FulGaz Clubs”) is made available to you, the user (“you”), by BIZAR MOBILE PTY LTD, a company formed under the laws of Australia, and/or its affiliates (collectively, “FulGaz”) subject to these Terms of Use (“Club Terms” or “Club Terms of Use”).
BY APPLYING FOR ACCESS TO FULGAZ CLUBS, YOU AGREE TO THESE CLUB TERMS OF USE; IF YOU DO NOT AGREE, DO NOT USE FULGAZ CLUBS.
FulGaz reserves the right, at its sole discretion, to change, modify, add, or remove portions of these Club Terms at any time. By continuing to access or use FulGaz Clubs after such revisions become effective, you agree to be bound by such changes or modifications.
Eligibility
By applying for access to FulGaz Clubs, you represent and warrant that (a) you have the power and authority to make such application as a representative of your club or coaching group (your “Club”) and grant the rights set out herein; (b) your application and any other information you submit, if any, is truthful and accurate; and (c) any User Content submitted by you is your own original work, it is not defamatory, it does not infringe any law, and you have all necessary rights in and to the User Content and the right to make it available to FulGaz.
FulGaz reserves the right, in its sole discretion, to (a) accept or reject your application to participate in the FulGaz Clubs program, which may be subject to a cap on the number of club or coaches active in FulGaz Clubs, and (b) terminate or suspend your access to, and/or use of, FulGaz Clubs or any element thereof, at any time, with or without notice and for any reason.
Acceptable Use
If you are successful in your application to FulGaz Clubs, you must not use your access to FulGaz Clubs for commercial purposes. You agree that you, and the Club you represent, will not charge Club members or ride participants any fee to participate in the activities that you or your Club may conduct via FulGaz Clubs. Club Logo, Club User Content
FulGaz Clubs may provide you with the opportunity to post photos, video, audio, comments, content, or other information that will then be shared publicly or with your Club members through the Site, or otherwise by FulGaz (“User Content”), including the uploading of your Club logo. By submitting User Content or information of any type, you automatically grant FulGaz a royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, edit, publish, translate, create derivative works from, distribute, transmit, perform, display, and otherwise use and sublicense such User Content or information (in whole or in part) worldwide and/or to incorporate into other works in any form, media, or technology now known or later developed for any commercial or non-commercial purpose without compensation, notice, or review, except where prohibited, for the full term of any rights that may exist in such User Content. FulGaz reserves the right to remove User Content that it deems in violation of the Club Terms and/or FulGaz Terms of Use in its sole discretion and without prior notice or liability to you.
Limited Licence of FulGaz Material
If you are successful in your application to FulGaz Clubs, FulGaz may (but is not obligated to) provide you with access to certain marketing materials relating to the FulGaz Clubs functionality (“FulGaz Materials”). Where such FulGaz Materials are provided to you, you are granted a limited, non-exclusive, revocable licence to use these FulGaz Materials for the duration of your FulGaz Clubs access period only, provided that: (i) such use is for non-commercial purposes and is solely for purposes of advertising your Club’s participation in FulGaz Clubs; and (ii) such use does not alter or change the FulGaz Material in any way including, but not limited to, recolouring, modifying, varying, incorporating with your Club’s own logo or any other alteration that FulGaz deems unacceptable and is notified to you. All right, title, and interest in and to the FulGaz Materials are and will remain the exclusive property of FulGaz.
Privacy
